## 2\. What personal information does Disctopia collect?

The information we gather from customers enables us to personalize and improve our services and allows our users to set up a user account and profile to interact with other users through the Disctopia website, applications, and platform. In connection with the Disctopia website, applications, and platform, we request and display some personal information to other users and visitors of the Disctopia website, applications, and platform, allowing users to identify each other. We receive and store any information you enter on our Disctopia website, applications, and platform or provide to us in any other way. The types of Personal Information collected may include your name, user name, email address, IP address, and browser information. ## 7\. What about cookies?

Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your browser to enable our systems to recognize your browser and tell us how and when pages in our Site are visited and by how many people. Disctopia cookies do not collect Personal Information, and we do not combine the general information collected through cookies with other Personal Information to tell us who you are or what your screen name or email address is.

Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. ## 8\. Microsoft Clarity

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. ## 9\. Will Disctopia Share Any of the Personal Information it receives?

Personal information about our customers is an integral part of our business. We neither rent nor sell your Personal Information to anyone. We share your Personal Information only as described below.

## 10\. Affiliated businesses we do not control

We are affiliated with various businesses and work closely with them. In certain situations, these businesses sell items to you through Disctopia's Disctopia website, applications, and platform. In other cases, Disctopia provides services or sells products jointly with affiliated companies. You can easily recognize when a related business is associated with your transaction. We will share your personal information about such transactions with that affiliated business if you have agreed to be solicited by marketing partners during the registration process.

## 11\. Agents

We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, Disctopia's agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. Email addresses are used to add new User Submissions to user profiles and to communicate through User Submissions. Users' email addresses will not be directly revealed to other users by Disctopia, except when the user is "connected" to another user via shared group membership or an invitation, or if the user has chosen to include their email address in their User Profile.

## 13\. Communication in response to user submissions

As part of the Disctopia website, applications, and platform, and Services, you will receive from a Disctopia email and other communication relating to your User Submissions. You acknowledge and agree that by posting such User Submissions, Disctopia may send you email and other communication that it determines in its sole discretion relate to your User Submissions.

## 14\. Business transfers

In some cases, we may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that is transferred. Moreover, if Disctopia or substantially all of its assets were acquired, or in the unlikely event that Disctopia goes out of business or enters bankruptcy, customer information would be one of the assets that are transferred or acquired by a third party. ## 18\. Personal information collected by creatives

As a condition to using certain features of our Disctopia website, applications, and platform and services (including, without limitation, the free download feature), you may be required to provide certain Personal Information to relevant Creatives, such as your email address, country of residence and zip/postal code ("Fan Information") to join the appropriate mailing list. As a condition to each such band's right to receive such Fan Information, Disctopia requires each band to agree that it 1) will not disclose, rent, or sell any Fan Information to any third party, 2) will use the Fan Information only in connection with the mailing list, to provide fans with general information and news about the band, and 3) will ensure that any email sent to its mailing list will include a mechanism by which the recipient can unsubscribe from the mailing list, along with clear instructions on how to do so (i.e., a functioning "opt-out" mechanism). However, Disctopia has no control over and no liability for using the Fan Information by the Creatives. You can choose not to provide such Fan Information, but you may not take advantage of the associated features. Please see the "Fan Personal Information – Fans" and "Fan Personal Information – Creatives" sections in the Disctopia Terms of Use for further information.

## 19\. Is personal information about me secure?

A password protects your Disctopia account's Personal Information for your privacy and security. You need to prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.

Disctopia endeavors to protect user information to ensure that user account information is kept private; however, Disctopia cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the protection of user information at any time. The Website and Disctopia Platform and Disctopia applications may contain links to other sites. Disctopia is not responsible for the privacy policies or practices on other sites. When linking to another site, you should read the privacy policy stated on that site. This Privacy Policy only governs information collected on the Disctopia website, applications, and platform.

A repeat infringer is a user for whom Disctopia has received more than two notices of claimed infringement or for which Disctopia has had to remove content more than twice. Notwithstanding the preceding sentence, Disctopia reserves the right to immediately terminate the account of any user for egregious infringing activities in Disctopia's sole determination and discretion.

### Procedure for Reporting Claimed Infringement:

If you believe that material or content residing on or accessible through the Disctopia Web site or Service infringes an intellectual property right that you own or control, please send a notice of claimed infringement containing the following information and only the following information to the Designated Agent listed below. Please note that you will be liable for damages, including costs and attorneys' fees, if you materially misrepresent that content or an activity is infringing your copyrights. Your communication must include all of the following items:

-   A physical or electronic signature of a person authorized to act on behalf of the owner of the Work that has been allegedly infringed;
-   Identification of works or materials being infringed;
-   Identification of the material that is claimed to be infringing, including information regarding the location of the infringing materials that the intellectual property owner seeks to have removed, with sufficient detail so that Disctopia is capable of finding and verifying its existence; Providing URLs in the body of an email is the best way to help us locate content quickly.
-   Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted;
-   The statement "I swear under penalty of perjury that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed and that the information in this notification is accurate. I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law." Note that a copy of your legal notice will be forwarded to the party responsible for providing the alleged infringing content. Please do not include any information in your report other than the above items. The wonderful thing about the DMCA is that it makes the sordid details of your bass player's departure completely irrelevant. Simply include the information above, and we'll have all the information we need.

### Once the Designated Agent receives proper Bona Fide Infringement Notification:

It is Disctopia's policy:

-   to remove or disable access to the infringing material;
-   to notify the content provider, member or user, that it has removed or disabled access to the material; and
-   that repeat offenders will have the infringing material removed from the system, and that Disctopia will terminate such content providers, member's or user's access to the Service.

### Procedure to Supply a Counter-Notice to the Designated Agent:

Suppose the content provider, member, or user believes that the material that was removed or to which access was disabled is either not infringing, or the content provider, member, or user acknowledges that it has the right to post and use such material from the owner of the intellectual property, the owner's agent or under the law, the content provider. In that case, member or user must send a counter-notice containing the following information to the Designated Agent listed below:

-   A physical or electronic signature of the content provider, member, or user;
-   Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
-   A statement that the content provider, member, or user has a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material; and
-   Content provider's, member's or user's name, address, telephone number, and, if available, email address and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the content provider's, member's or user's address is located, or if the content provider's, member's or user's address is located outside the United States, for any judicial district in which Disctopia is located, and that such person or entity will accept Service of process from the person who provided notification of the alleged infringement. If the Designated Agent receives a counter-notice, Disctopia may send a copy of the counter-notice to the original complaining party informing that the Disctopia may replace the removed material or cease disabling it in 10 business days. Unless the owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice at Disctopia's discretion.

## 25\. Personal data deletion

Even though your account may be deleted, if a user or creative returns to the platform, some soft data or personal information may be retained only for account reactivation purposes. If you would like all of the Personal data removed from the application, platform, and all of the properties owned by Disctopia, you must submit a request via email to [support@Disctopia.com](mailto:support@disctopia.com).

## 26\. Integration with YouTube API Services Terms of Service

By using Disctopia's services, you acknowledge and agree to be bound by the YouTube Terms of Service. Our use of YouTube API Services is subject to compliance with YouTube's policies and guidelines, and by using any features or functionalities that involve YouTube API Services, you are also agreeing to adhere to their terms.

Disctopia's integration with YouTube API Services requires us to collect and process certain data as outlined below. By using features that utilize YouTube API Services, you consent to this data processing in accordance with our Privacy Policy.

### Use of YouTube API Services:

## 27\. Apple Podcasts Connect Integration

If you connect your Disctopia account to [Apple Podcasts](https://podcasters.apple.com/), Disctopia integrates with [Apple Podcasts Connect](https://podcastsconnect.apple.com/) ("PCC") on your behalf to deliver shows, episodes, [premium subscriber content](https://podcasters.apple.com/878-subscriptions), and (where eligible) video episodes to Apple. By connecting, you authorize Disctopia to act as your delivery agent with Apple and you consent to the data flows described in this section.

### Credentials we store on your behalf

To deliver content to Apple Podcasts, Disctopia stores three credentials you obtain from Apple Podcasts Connect: your Apple Provider ID, your Apple Key ID, and your Apple `.p8` private signing key. All three are stored encrypted at rest in Microsoft Azure Key Vault (a FIPS 140-2 validated hardware security module) under access policies that restrict retrieval to Disctopia's Apple-integration service identity. The `.p8` key never leaves Disctopia's servers and is not exposed to your browser, mobile device, or any other Disctopia subsystem after upload.

### Data shared with Apple

To submit and manage your shows on Apple Podcasts, Disctopia transmits the following to Apple's Podcasts Connect API: show and episode metadata (title, description, artwork URLs, category, language), your RSS feed URL (for RSS-delivered shows), audio and video media assets (for direct-delivered episodes), and signed API requests authenticated with your Apple credentials. We do not transmit your Disctopia password, payment information, listener data, or any other Disctopia account data to Apple.

### Data we receive from Apple

Apple returns delivery status, show and episode identifiers, validation errors, takedown notices, and (where applicable) Apple Podcasters Program enrollment status. Disctopia stores this information against your account so we can show you the state of your Apple delivery. We do not receive listener-level analytics, subscriber identities, or payment information from Apple — Apple Podcasters Program revenue, where applicable, is paid by Apple directly to you and does not flow through Disctopia.

### Audit logging

Every Apple API call made on your behalf is logged to an internal audit table (Apple call type, timestamp, request status, Disctopia user identifier). We retain these audit records for seven (7) years following the date of the call, even after you delete your account, because Disctopia is contractually obligated to be able to produce a record of API activity in connection with Apple's audit and indemnification provisions. After account deletion the user identifier in the audit table is pseudonymized so the record can no longer be linked back to your personal information; only the operational fact of the call is retained.

### What happens when you disconnect or delete your account

You may disconnect Apple Podcasts from Disctopia at any time from your account settings. On disconnection, Disctopia immediately revokes Apple API access for your account and purges your stored Apple `.p8` key from Azure Key Vault. If you delete your Disctopia account, the Apple `.p8` key is purged within 30 days and the associated audit records are pseudonymized as described above. Shows already published to Apple Podcasts remain on Apple under Apple's own retention policies; you must contact Apple directly to remove a previously delivered show from Apple's catalog.

### Your rights under GDPR, UK GDPR, and CCPA / CPRA

If you are a resident of the European Economic Area, the United Kingdom, California, or another jurisdiction with comparable privacy law, you may exercise your rights of access, rectification, erasure, restriction, portability, and objection in respect of the Apple-integration data described above by emailing [support@disctopia.com](mailto:support@disctopia.com). We will respond within the timeframe required by applicable law. The seven-year retention of pseudonymized audit records described above is performed under the lawful basis of legitimate interest in meeting our contractual obligations to Apple and defending against legal claims.

### Apple's processing of your data

Once Disctopia transmits content and metadata to Apple, Apple processes that data under [Apple's Privacy Policy](https://www.apple.com/legal/privacy/) and the [Apple Podcasts Connect Terms of Service](https://apple.co/pcctos) you accepted when you connected your account. Disctopia does not control and is not responsible for Apple's processing of your data after delivery.

Will Disctopia still be around in 10 years?

Video uploads cap at 50 GB/week on the Agency tier. Audio uploads (music, podcasts, audiobooks) are unlimited. The 50 GB/week reset is rolling — most creators never come close to the cap. Heavy filmmakers can stagger uploads or contact support for enterprise options.

## $0.02 × your qualifying plays. That's the formula.

Most platforms pay from a pooled royalty pot, so what you earn per play depends on what everyone else did that month and can't be worked out in advance. Disctopia publishes a flat rate instead, which means you can calculate your own earnings before you ever upload anything. A _qualifying_ play is a TruePlay™ on a Disctopia-exclusive release, by a paying subscriber — the next section covers exactly what that means:

These are illustrations of the arithmetic, not a forecast for your show. What you actually earn depends on how many of your plays qualify — exclusive release, paying listener, verified listen — plus ad revenue on the plays that don't. The rate is fixed; the plays are yours to build.

What counts

## What has to be true for a play to pay

Three conditions, all of them required. This is the part most platforms bury, so it's worth being blunt about: a play that misses any one of these doesn't earn the per-play rate.

### 1\. Exclusive to Disctopia

The episode or track is released here and not also published elsewhere. Exclusivity is judged **per item, not per show** — keep your main feed on Apple and Spotify, and choose which individual releases to make exclusive.

### 2\. A paying subscriber

The listener holds a paid Disctopia plan. The per-play rate is funded out of subscription revenue, which is what lets it stay flat and published rather than floating with a royalty pool.

### 3\. A genuine listen

The play clears Disctopia's TruePlay™ verification — real, audience-driven listening rather than accidental autoplay, bot traffic, or artificial streaming. A platform paying a fixed rate per raw play would be drained by fraud inside a month.

### Everything else earns ads

Plays that don't qualify aren't wasted. Free-tier listens and non-exclusive releases are monetized through advertising instead, so your whole catalogue earns — the per-play rate and the ad rate are simply two different mechanisms.

### Paid weekly
